Terms of Service

These terms govern the hosted services at assay.rs, auth.assay.rs and
engine.assay.rs, operated by NSM Technologies Limited, a company registered in
England and Wales under number 16748005 with its registered office at 7 Sanderling Close,
Bicester, England, OX26 6WF.
The software and the service are different things
Assay itself is open source software licensed under Apache 2.0. That licence governs your use of the software, including running it yourself, and nothing in these terms restricts the rights it grants you.
These terms apply only to the instances we host and operate. If you self-host Assay, you operate that deployment and these terms do not apply to it.
Your account
You must give accurate registration details and keep your credentials secure. You are responsible for activity under your account. Tell us promptly at info@nsmtechnologies.co.uk if you believe it has been compromised.
You must be old enough to form a binding contract in your jurisdiction. The service is not directed at children.
Acceptable use
You agree not to:
- use the service unlawfully, or to store or transmit unlawful material
- attempt to gain unauthorised access to the service, other accounts, or the systems behind them
- probe or test the service's security without our written permission, or disrupt its operation
- place an unreasonable load on the service, or circumvent any rate limit or quota
- impersonate another person, or misrepresent your affiliation with anyone
We may suspend or terminate access that breaches these terms, or that threatens the security or stability of the service for others.
Availability
The hosted service is provided on a best-effort basis without any uptime commitment. We may change, suspend or withdraw it, in whole or in part, at any time. We will give reasonable notice of a planned withdrawal where we can.
Because Assay is open source, a shutdown of the hosted service does not deprive you of the software; you can run your own instance under the Apache 2.0 licence.
No warranty
The hosted service is provided 'as is' and 'as available'. To the extent permitted by law we exclude all implied warranties and conditions, including those of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error free.
Our liability
To the extent permitted by law, we are not liable for loss of profit, loss of business, business interruption, loss of data or loss of anticipated savings, nor for any indirect or consequential loss, arising from your use of or inability to use the hosted service.
Where we are liable, our total liability in any twelve month period is limited to the greater of the amount you paid us for the service in that period, or one hundred pounds sterling.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
Ending your use
You may stop using the service and delete your account at any time. We may terminate or suspend your access if you materially breach these terms, or if we withdraw the service. On termination your account data is deleted as described in our Privacy Policy.
Changes to these terms
We may revise these terms by updating this page and the date above. Where a change materially affects your rights we will give reasonable notice. Continuing to use the service after a change takes effect means you accept the revised terms.
Governing law
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
